A right circular cone whose base has a radius of 4 cm and whose height is greater than 2 cm is inscribed in a sphere with a radius of 5 cm, as shown. What is the ratio of the volume of the cone to the volume of the sphere? Express your answer as a common fraction

I'm struggling a bit with the "as shown" part.
Anyway, how high up on the sphere is the base of the cone? There is a reason why they told you "greater than 2". That's important.
What do you know about Pythagorean Triples? 3-4-5 comes to mind.
