i know that the fundamental law is using maximum in the red marked areas

but here

What exactly is your question? You have just made a statement about max!
In the proof, by letting $\delta = \min \left\{ {1,\frac{\varepsilon }
{{11}}} \right\}$
the author insures both the previous conditions will remain true.

i saw a similar proof that i published before which is very similar to this one but uses MAX
and i am puzzled
why?
